A 26-year-old man from Trenton, Davion S. Smith, was convicted this week on multiple charges, including aggravated assault and weapons offenses, following his involvement in a shooting incident in August 2022.
The verdict, returned by a jury on February 5, 2025, found Smith guilty on all counts outlined in the indictment, which included unlawful possession of a handgun, possession of a firearm for an unlawful purpose, aggravated assault, and certain persons not to possess a firearm.
The incident occurred in the early hours of August 13, 2022, when Trenton Police responded to reports of shots fired in the 100 block of Oakland Avenue.
Upon arrival, officers observed a vehicle, later determined to be driven by Smith, leaving the area at a high rate of speed. A subsequent search of the vehicle uncovered a defaced .38 caliber revolver.
Surveillance footage from the scene captured Smith firing the handgun in the direction of another vehicle before fleeing the area.
The case was prosecuted by Assistant Prosecutors Michael J. Mennuti and Jeffrey C. McElwee Jr., who represented the state throughout the two-week trial.
.Mercer County Prosecutor Janetta D. Marbrey commended the investigation led by the Mercer County Shooting Response Team and Detective Sarai Cheek of the Trenton Police Department. Smith was represented by attorney Andrew Seewald, Esq.
Smith is scheduled for sentencing on April 4, 2025, and he faces a potential sentence of up to 30 years in prison.
This extended term sentence is possible due to Smith’s eligibility under New Jersey’s “Persistent Offender” statute, N.J.S.A. 2C:44-3a, based on his prior criminal record.
