Montvale landscaper fined $382,488 for stiffing crew on mandatory overtime pay

In a recent investigation led by the U.S. Department of Labor’s Wage and Hour Division, John Mirza Landscaping Inc., located at 49 Spring Valley Road, Montvale, NJ 07645, has been found guilty of withholding overtime pay from its employees.

The inquiry revealed a blatant violation of the Fair Labor Standards Act (FLSA) as the company failed to compensate non-exempt landscapers with the mandatory overtime premium for hours exceeding 40 in a workweek.

The findings of the investigation disclosed that the employees were denied their rightful compensation, as stipulated by federal labor laws.

The Department of Labor’s meticulous examination resulted in the recovery of $127,496 in back wages, alongside an equal sum in liquidated damages, collectively amounting to $254,992, reimbursed to 20 affected workers.

Paula Ruffin, the District Director of the Wage and Hour Division, based in Mountainside, New Jersey, emphasized the importance of compliance with labor regulations, stating, “The onus is on landscaping employers to understand federal labor laws and not shortchange employees’ hard-earned wages by paying straight time hourly rates for overtime hours worked.”
